This contract has been prepared in accordance with the provisions of Law No. 4822 Amending Law No. 4077 on the Protection of the Consumer and the Regulation on the Principles and Procedures of Distance Contracts, regarding the mutual rights and obligations between the Consumer placing an order and the Seller, the owner of this website, for the product specified below, its features and sale price, through the piyerasilver.com website.

Article 5) GENERAL PROVISIONS


5.1. The CONSUMER acknowledges, declares, and undertakes that they have read and understood the basic characteristics of the product subject to the contract, the sale price, the payment method, and the preliminary information regarding delivery on the SELLER's website, and that they have given the necessary confirmation electronically. The CONSUMER acknowledges, declares, and undertakes that they have obtained accurate and complete information about the address to be given before the conclusion of the distance sales contract, the main features of the products ordered, the total price including taxes of the products, and the payment and delivery details.


5.2. Each product subject to the contract will be delivered to the CONSUMER or the person/organization at the address indicated by the CONSUMER within the period specified on the website, depending on the distance of the CONSUMER's residence, provided that it does not exceed 30 days. If the product cannot be delivered to the CONSUMER within this period, the CONSUMER has the right to terminate the contract.


5.3. The SELLER undertakes to deliver the product subject to the contract in a complete and undamaged manner, in accordance with the specifications specified in the order, complete with warranty documents and user manuals, and to fulfill the requirements of the law, to perform the work in accordance with the requirements of the legislation, and to take necessary care and attention during the performance of the work, to perform the work with accuracy and honesty, and to act with caution and foresight.


5.4. The SELLER can provide a product of equal quality and price instead of the product subject to the contract, by informing the CONSUMER and obtaining explicit consent before the performance of the contractual obligation expires.


5.5. If the SELLER cannot fulfill the obligations arising from the contract due to reasons beyond its control, which were not foreseeable at the time of the conclusion of the contract and which prevent or delay the fulfillment of its obligations, the SELLER accepts, declares, and undertakes to inform the CONSUMER in writing within 3 days from the date of learning, return the total price to the CONSUMER within 14 days, if any, and to bear the transportation costs of the returned product for 3 days.


5.6. If the CONSUMER does not pay the price of the product subject to the contract or cancels the payment in the bank records for any reason, the SELLER's obligation to deliver the product shall cease automatically and the SELLER shall be free from any obligation to deliver the product.


5.7. If the product subject to the contract is delivered to the CONSUMER or the person/organization at the address indicated by the CONSUMER after the delivery of the product, if the CONSUMER's credit card used in the payment is used by unauthorized persons without the CONSUMER's consent and as a result of the unfair use of the credit card, provided that it is not caused by the CONSUMER's fault, the CONSUMER must return the product to the SELLER within 3 days with the shipping fee belonging to the SELLER. In this case, shipping costs are borne by the CONSUMER.


5.8. If the SELLER cannot deliver the product subject to the contract within the period due to force majeure or extraordinary circumstances that prevent or delay the fulfillment of its obligations, the SELLER accepts, declares, and undertakes to inform the CONSUMER about the situation and the CONSUMER has the right to cancel the order, request replacement of the product with a similar one, or postpone the delivery period until the obstacle disappears. In case the CONSUMER cancels the order, in cash payments made by the CONSUMER, the product price will be refunded to the CONSUMER within 14 days in cash and at once. In case of payments made by the CONSUMER with a credit card, the product price will be refunded to the relevant bank within 14 days after the order is canceled. The CONSUMER acknowledges that the process of reflecting the refunded amount to the CONSUMER's accounts by the bank may take 2 to 3 weeks after it is refunded by the SELLER to the credit card, and that the SELLER cannot be held responsible for possible delays.


5.9. The SELLER has the right to reach the CONSUMER through the contact information provided by the CONSUMER when registering on the SELLER's website for communication, marketing, notification, and other purposes, in accordance with the relevant legal regulations. By accepting this contract, the CONSUMER acknowledges and declares that the SELLER has the right to carry out the above-mentioned communication activities towards them.


5.10. The CONSUMER will inspect the product/service before accepting the delivery; damaged, broken, torn packaging, etc. damaged and defective products/services will not be received from the shipping company. The received product/service will be deemed undamaged and intact. If the right of withdrawal will be used, the product/service should not be used. The invoice should be returned.


5.11. If the credit card holder used during the order process is not the same person as the CONSUMER or if there is a security vulnerability related to the credit card used in the order before the product is delivered to the CONSUMER, the SELLER may request the CONSUMER to provide the identity and contact information of the credit card holder used in the order or a previous month's statement of the credit card used in the order or a letter from the bank stating that the credit card belongs to the cardholder. The order will be suspended until the requested information/documents are provided by the CONSUMER, and if these requests are not met within 24 hours, the SELLER has the right to cancel the order.


5.12. The CONSUMER acknowledges and undertakes that the personal and other information provided during the registration process on the SELLER's website is accurate and that they will compensate the SELLER for all damages that the SELLER will incur due to the falsity of this information, immediately, in cash and at once, upon the
